🇬🇧 Terms and Conditions (T&C)
1. Scope of Application
These Terms and Conditions (hereinafter referred to as “T&C”) apply to all contracts concluded via the online shop of:
Bluemate Gear
Owner: Emanuel Zingsem
Höhenberg 12
41539 Dormagen
Germany
Email: bluemategear@gmail.com
between the seller and the customer.
A consumer within the meaning of these T&C is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.
2. Conclusion of Contract
The products presented in the online shop do not constitute legally binding offers but rather a non-binding invitation to place an order.
By clicking the button “Buy now” or “Place order with obligation to pay”, the customer submits a binding offer to conclude a purchase contract.
The contract is concluded when the seller accepts the order by sending an order confirmation via email or by dispatching the goods.
Contract Language
The language available for the conclusion of the contract is German.
Storage of Contract Text
The contract text is stored by the seller and sent to the customer via email after conclusion of the contract. Further access to the contract text is not provided.
3. Prices and Payment Terms
All prices are final prices in Euro.
If the seller is a small business within the meaning of § 19 UStG, no VAT is shown.
Additional shipping costs may apply and are displayed separately during the ordering process.
Payment is made using the payment methods offered in the online shop.
4. Delivery and Shipping
Delivery is made to the delivery address specified by the customer.
Delivery times are indicated in the respective offer.
If a product is not available, the customer will be informed immediately. Payments already made will be refunded without delay.
5. Retention of Title
The goods remain the property of the seller until full payment has been made.
6. Right of Withdrawal
Consumers have a statutory right of withdrawal.
Details can be found in the seller’s separate withdrawal policy.
7. Warranty
The statutory warranty rights apply.
8. Liability
The seller is fully liable for damages resulting from injury to life, body or health.
The seller is also fully liable for damages caused by intentional or grossly negligent breach of duty.
In the case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for the contract.
Any further liability is excluded.
Liability under the Product Liability Act remains unaffected.
9. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR):
https://ec.europa.eu/consumers/odr
The seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
10. Applicable Law
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11. Final Provisions
Should individual provisions of these T&C be invalid or become invalid, the validity of the remaining provisions shall remain unaffected.
